BE THE BOXER Terms of Service

This is a reference translation. The Japanese version is authoritative; if any discrepancy exists, the Japanese version prevails.

These Terms of Service ("Terms") set out the conditions for using the game app "BE THE BOXER" ("the Service") provided by VAULT LLC (合同会社VAULT; "we"). All users of the Service ("Users") shall use the Service after agreeing to these Terms.

Article 1 (Application)

• These Terms apply to all relationships between Users and us concerning the use of the Service.
• We may change the content of these Terms. Users who continue to use the Service after the revised Terms have been announced in the Service or on this page are deemed to have agreed to the revised Terms.
• The handling of personal information and other data in the Service is governed by the separately established "Privacy Policy".

Article 2 (Overview of the Service)

• The Service is a boxing game in which the front camera of your device reads your body movement and you fight opponents by actually punching and dodging.
• Some features (keeping saved data, transferring data and news) require communication with our servers.

Article 3 (Age and conditions of use)

• Users under 18 years of age shall use the Service with the consent of a parent or guardian.
• The Service does not require account registration. Game data is stored on the User's device, and a copy is automatically stored on our servers.
• Users can move their data to another device using a transfer code and password issued from "Transfer data" on the Settings screen. After the transfer, the data can no longer be used on the original device. Users are responsible for managing their own transfer codes and passwords.
• We do not guarantee that data can be restored if data on the device is lost before it is stored on our servers, or if data cannot be moved because a transfer code or password has been lost or has expired, or the like.
• Users can request the deletion of their data on our servers by following the steps set out in the Privacy Policy. Deleted data cannot be restored.

Article 4 (Playing safely)

• The Service involves big body movements. Users shall make sure there are no people, objects or steps within 1.5 m (5 ft) of them, and play on a non-slip floor.
• Stand your device firmly where it cannot fall over.
• Don't play if you feel unwell, are injured, have a medical condition, are pregnant, or have been told by a doctor not to exercise. If you have any concerns, consult a doctor first.
• Rest when you're out of breath, and stop immediately if you feel pain or dizziness.
• Children should play under the supervision of a parent or guardian.

Article 5 (Estimated values)

• Values such as calories burned are estimates. They cannot be used for medical, diagnostic or health-management purposes.

Article 6 (Photo face feature)

• For the feature that puts a face on TARGET, only use photos of yourself or photos where the people shown have agreed. Photos are handled as described in the Privacy Policy.

Article 7 (Prohibited conduct)

When using the Service, Users must not engage in the following conduct.

• Tampering with, analyzing, or modifying the Service's app, data, or communications
• Intentionally exploiting bugs in the Service
• Impersonating others, or infringing the intellectual property rights, portrait rights, privacy, or other rights of others
• Using a photo of another person without their consent
• Interfering with the operation of the Service, or gaining unauthorized access to servers or systems
• Conduct that violates laws or public order and morals
• Any other conduct that we judge to be inappropriate

Article 8 (Measures in case of violation)

If a User violates these Terms, we may, without prior notice, take measures such as suspending their use of the Service.

Article 9 (Intellectual property rights)

The intellectual property rights in the Service and in the characters, images, audio, programs, and other materials provided in the Service belong to us or to the legitimate rights holders.

Article 10 (Disclaimer)

• We do not warrant that the Service is free from defects in fact or in law (including those concerning safety, reliability, accuracy, and fitness for a particular purpose).
• Except in cases of our willful misconduct or gross negligence, we are not liable for injury, damage to property or device failure that occurs while using the Service.
• Except in cases of our willful misconduct or gross negligence, we are not liable for any damage incurred by Users in connection with the Service. However, this does not apply where our liability cannot be exempted under the Consumer Contract Act or other laws.

Article 11 (Changes to and termination of the Service)

• We may change the content of the Service, or suspend or end its provision. If we end the Service, we will announce it in the Service or on this page with a reasonable period of advance notice.
• We are liable for any damage incurred by Users due to changes to or the termination of the Service to the extent set out in the preceding Article.

Article 13 (Governing law and jurisdiction)

• The interpretation and application of these Terms are governed by the laws of Japan.
• The Tokyo District Court shall be the exclusive agreed court of first instance for any dispute arising between a User and us in connection with the Service.
• The Japanese version of these Terms is authoritative. Other language versions are translations for reference.
