本利用規約（以下、「本規約」といいます。）は、合同会社VAULT（以下、「当社」といいます。）が提供する「picmi」（以下、「本サービス」といいます。）の利用条件を定めるものです。本サービスを利用するすべてのユーザー（以下、「ユーザー」といいます。）は、本規約に同意した上で本サービスを利用するものとします。
 

第1条（適用）

  1. 本規約は、ユーザーと当社との間の本サービスの利用に関わる一切の関係に適用されます。
  1. 当社は、ユーザーに対し、本規約の内容を変更することがあります。変更後の本規約は、本サービス上での告知後、ユーザーが本サービスを継続して利用することにより同意したものとみなします。
  1. アプリのインストールやサインインの有無にかかわらず、招待URL・QRコード等を通じてブラウザその他の手段でアルバムの共同編集に参加し、落書き等の編集を行う者（以下、「ゲスト参加者」といいます。）も本規約上の「ユーザー」に含まれ、参加・編集を行った時点で本規約に同意したものとみなします。

第2条（サービスの概要）

  1. 本サービスは、ユーザーが撮影または取り込んだ写真をグリッドに並べ、ペン・テキスト・絵文字・ステッカー・AI加工等の落書きを加えて、1枚の写真を作成・保存・共有できる写真サービスです。
  1. 本サービスには、複数のユーザーが1つのアルバム（写真）を共同で編集するグループ機能が含まれます。共同編集はリアルタイムに同期されます。
  1. AI落書き等の一部の機能は、クラウド上のサーバーおよび外部の生成AIサービスで処理されます。
  1. 本サービスの提供地域は日本国内を想定しています。

第3条（対象ユーザーおよび年齢制限）

  1. 本サービスは13歳以上のユーザーを対象としています。13歳未満の方は本サービスを利用することはできません。
  1. 18歳未満のユーザーは、保護者の同意を得た上で本サービスを利用するものとします。
  1. 年齢要件を満たさないことが判明した場合、当社は当該アカウントを停止または削除する権利を有します。

第4条（アカウント）

  1. 本サービスの通常の利用には、Appleの「Sign in with Apple」またはGoogleアカウントによるサインインが必要です。
  1. 招待URL・QRコードを通じてアルバムに参加する場合に限り、サインインを行わない匿名のゲスト参加者として編集に参加できます。ゲスト参加者は、落書き等の編集のみを行うことができ、写真の追加はできません。
  1. ゲスト参加者は、後からサインインして恒久的なアカウントを作成することで、それまでの参加情報を同一のアカウントに引き継ぐことができます。サインイン後は、写真の追加を含む機能を利用できます。
  1. サインインは、機種変更・再インストール後も購入・プランおよびデータを引き継ぐために用いられます。ユーザーは、サインインに用いるApple IDおよびGoogleアカウントを自らの責任で管理するものとします。
  1. ユーザーは、表示名・アイコンその他の設定を自らの責任で管理するものとします。
  1. ユーザーは、設定画面からいつでもアカウントを削除できます。削除したアカウントおよび関連データは復元できません。

第5条（料金・課金）

  1. 本サービスには、無料で利用できる範囲と、有料プラン（月定額のサブスクリプション「Premium」）があります。各プランの内容および価格はアプリ内に表示されます。
  1. 課金は、Apple App StoreまたはGoogle Play等のアプリ内課金を通じて処理されます。
  1. 月定額プランは、解約手続きを行わない限り自動的に更新されます。解約は、ご利用のアプリストアのサブスクリプション管理画面から行うものとします。
  1. 料金の返金は、原則としてご利用のアプリストアの規定に従います。
  1. AI落書きなどの一部機能は、プランに含まれる回数（クレジット）の範囲内で利用できます。クレジットは毎月リセットされ、未使用分の翌月への持ち越しはありません。
  1. 無料プランでは、最終の編集から一定の期間（現時点では45日間）操作のないアルバムについて、編集用の元写真が自動的に削除される場合があります。完成・書き出し済みの画像は引き続き保持されます。期間その他の詳細はアプリ内およびFAQに従い、当社はこれを変更することがあります。
  1. 当社は、料金やプランの内容を変更することがあります。変更はアプリ内で告知します。

第6条（投稿コンテンツの取扱い）

  1. ユーザーが本サービスで撮影・取り込み・作成したコンテンツ（写真、落書き、テキスト等。以下、「投稿コンテンツ」といいます。）の権利は、ユーザーまたは正当な権利者に帰属します。
  1. 当社は、本サービスの提供・運営に必要な範囲（クラウドでの保管・処理、写真の生成・書き出し、アルバム参加者への共有、AI落書きのための外部生成AIサービスへの送信等）で、投稿コンテンツを使用できるものとします。
  1. ユーザーは、投稿コンテンツについて、自らが権利を有するか、または必要な許諾を得ていることを保証します。写真に他人が写っている場合は、必要な同意を得るものとします。
  1. ユーザーがAI落書き機能を利用する場合、対象となる写真等が、当該機能の提供のために外部の生成AIサービスへ送信されることに同意するものとします。
  1. 以下に該当すると当社が判断した投稿コンテンツは、当社が事前通知なく削除できるものとします。
      • 公序良俗に反する内容
      • 違法行為またはこれを助長する内容
      • 他者を誹謗中傷し、または他者の権利を侵害する内容
      • 児童の性的虐待や搾取（CSAE）に該当する内容、またはそれを助長する内容
      • 児童性的虐待のコンテンツ（CSAM）に該当する内容
      • その他、当社が不適切と判断した内容

第7条（グループ機能）

  1. アルバムの作成および参加は、すべてのユーザーが無料で利用できます。参加は、招待URLまたはQRコードを通じて行います。
  1. アルバムのオーナーは、招待URL・QRコードの管理に責任を負うものとします。招待を受けた参加者は、アルバム内の写真を閲覧・編集・保存できます。ゲスト参加者は編集（落書き）のみを行うことができ、写真の追加はできません。
  1. 協働での落書きはリアルタイムに同期されます。ユーザーは、他の参加者が加えた落書きを削除できません（自らが加えた落書きの取り消しは可能です）。
  1. ユーザーは、アルバムで共有される写真に他の参加者や被写体が含まれることを理解した上で、グループ機能を利用するものとします。

第8条（子どもの安全に関する基準）

  1. 基本方針　当社は、本サービスにおける子どもの安全を最優先事項として位置づけ、児童の性的虐待と搾取（CSAE）の防止に全力で取り組みます。本サービスにおいて、CSAEに該当するいかなるコンテンツおよび行為も厳格に禁止します。
  1. 禁止されるコンテンツおよび行為　本サービスでは、以下を一切禁止します。
      • 児童性的虐待のコンテンツ（CSAM）の投稿、共有、保存、または配布
      • 性的搾取を目的とした未成年者への接触（グルーミング）
      • 未成年者に対するセクストーション（性的脅迫）
      • その他、未成年者に対する性的搾取または虐待に該当するあらゆる行為
  1. CSAMへの対応　当社は、CSAMを発見した場合、直ちに該当コンテンツを削除し、関連するユーザーアカウントの即時停止または永久削除を行い、日本国の法令に基づき関係当局（警察、インターネット・ホットラインセンター等）への通報を行います。
  1. 法令遵守　当社は、児童の安全に関連する日本国内の法律・規制（児童買春・児童ポルノ禁止法、児童福祉法等）を遵守し、必要に応じて運用体制の見直しを行います。

第9条（通報）

  1. ユーザーは、本サービスにおいて不適切なコンテンツや行為（子どもの安全に関する問題を含む）を発見した場合、アプリ内の通報機能またはお問い合わせ窓口を通じて当社に報告できます。
  1. 当社は、不適切なコンテンツや迷惑行為に対して一切容認しない方針です。通報を受けた事案については原則として24時間以内に確認し、不適切と判断したコンテンツの削除、または当該ユーザーの利用停止・アカウント削除等の措置を講じます。子どもの安全に関する通報については、最優先で対応します。
  1. ユーザーは、子どもの安全に関する問題について、以下の連絡先にも直接報告することができます。

第10条（禁止事項）

ユーザーは、本サービスの利用にあたり、以下の行為をしてはなりません。
  1. 他者になりすます行為
  1. 他者の知的財産権、肖像権、プライバシーその他の権利を侵害する行為
  1. 違法行為または違法行為を助長する行為
  1. 他者への嫌がらせ、脅迫、誹謗中傷
  1. 不適切な投稿（暴力的、わいせつ、差別的な表現を含むもの）
  1. 児童の性的虐待や搾取（CSAE）に該当する行為、またはそれを助長・幇助する行為
  1. 児童性的虐待のコンテンツ（CSAM）の投稿、共有、保存、または配布
  1. 未成年者に対するグルーミング、セクストーション、その他の性的搾取行為
  1. 年齢を偽って本サービスを利用する行為
  1. 本サービスの運営を妨げる行為、またはサーバー・システムに不正にアクセスする行為
  1. その他、当社が不適切と判断する行為

第11条（違反時の措置）

  1. 当社は、ユーザーが本規約に違反した場合、事前通知の有無にかかわらず、投稿コンテンツの削除、アカウントの一時停止・永久削除、法令に基づく関係当局への通報等の措置を講じることができます。
  1. 子どもの安全に関する違反については、発覚次第、直ちにアカウントの永久削除および関係当局への通報を行います。

第12条（知的財産権）

  1. 本サービスそのもの、および本サービスが提供するステッカー・テンプレート・エフェクト・ブランド素材その他の素材に関する知的財産権は、当社または正当な権利者に帰属します。
  1. ユーザーは、本サービスで作成した写真を、本規約および関連する法令の範囲内で、個人的・商用を問わず利用（SNSへの投稿を含む）できます。
  1. 無料プランで書き出した画像には、当社のブランド透かしおよびアルバムへの参加用QRコードが付与される場合があります。

第13条（免責事項）

  1. 当社は、本サービスに事実上または法律上の瑕疵（安全性、信頼性、正確性、特定目的への適合性等）がないことを保証するものではありません。
  1. ユーザー間またはユーザーと第三者との間で生じたトラブルについて、当社は一切の責任を負いません。
  1. AI落書きなどの生成結果がユーザーの期待に沿わない場合でも、当社は責任を負いません。
  1. 当社の故意または重過失による場合を除き、本サービスに関してユーザーに生じた損害について、当社は責任を負いません。

第14条（サービスの変更・終了）

  1. 当社は、ユーザーへの事前通知なく、本サービスの仕様変更、提供の中止または終了を行うことができます。
  1. 本サービスの変更または終了によりユーザーに生じた損害について、当社は責任を負いません。

第15条（準拠法・裁判管轄）

  1. 本規約の解釈および適用は、日本法に準拠します。
  1. 本サービスに関連してユーザーと当社の間で生じた紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service ("Terms") set out the conditions for using "picmi" ("the Service"), provided by VAULT LLC (合同会社VAULT; "we"/"us"). All users ("Users") use the Service on the basis that they agree to these Terms.

Article 1 (Application)

  1. These Terms apply to all relationships between Users and us regarding use of the Service.
  1. We may change these Terms. Changed Terms are deemed accepted when a User continues using the Service after we announce them in the Service.
  1. Regardless of whether they install the app or sign in, anyone who joins collaborative album editing via a browser or other means through an invite URL, QR code, etc., and who adds doodles or other edits ("Guest Participants") is also included in "Users" under these Terms and is deemed to have agreed to these Terms at the time of joining or editing.

Article 2 (Overview)

  1. The Service is a photo service that lets Users arrange photos they shoot or import into a grid, add doodles (pen, text, emoji, stickers, AI edits, etc.), and create, save, and share a single photo.
  1. The Service includes a group feature where multiple Users collaboratively edit one album (photo). Collaborative editing is synced in real time.
  1. Some features, such as AI doodles, are processed on cloud servers and external generative-AI services.
  1. The Service is intended for use within Japan.

Article 3 (Eligible users and age)

  1. The Service is for users aged 13 and over. Those under 13 may not use it.
  1. Users under 18 must use the Service with a guardian's consent.
  1. If a User is found not to meet the age requirement, we may suspend or delete that account.

Article 4 (Account)

  1. Normal use of the Service requires signing in with "Sign in with Apple" or a Google account.
  1. Only when joining an album via an invite URL or QR code may you participate in editing as an anonymous Guest Participant without signing in. Guest Participants may only edit (e.g., doodle) and cannot add photos.
  1. A Guest Participant may later sign in to create a permanent account, carrying over their prior participation data to the same account. After signing in, they can use features including adding photos.
  1. Signing in is used to carry over purchases, plans, and data across device changes and reinstalls. Users manage the Apple ID and Google account used to sign in at their own responsibility.
  1. Users manage their display name, icon, and other settings at their own responsibility.
  1. Users may delete their account anytime from Settings. Deleted accounts and related data cannot be restored.

Article 5 (Fees and billing)

  1. The Service has a free tier and a paid plan (the monthly subscription "Premium"). Plan contents and prices are shown in the app.
  1. Billing is processed through in-app purchase such as the Apple App Store or Google Play.
  1. Monthly plans renew automatically unless cancelled. Cancel from your app store's subscription management.
  1. Refunds in principle follow your app store's rules.
  1. Some features, such as AI doodles, are available within the number of times (credits) included in your plan. Credits reset monthly and unused credits do not carry over to the next month.
  1. On the free tier, for albums with no activity for a certain period after the last edit (currently 45 days), the original source photos used for editing may be deleted automatically. Completed/exported images are retained. The period and other details follow the app and FAQ and may be changed by us.
  1. We may change fees or plan contents; changes are announced in the app.

Article 6 (Handling of posted content)

  1. Rights to content the User shoots/imports/creates ("Posted Content": photos, doodles, text, etc.) belong to the User or rightful holder.
  1. We may use Posted Content within the scope necessary to provide/operate the Service (cloud storage/processing, generating/exporting photos, sharing with album participants, sending to external generative-AI services for AI doodles, etc.).
  1. Users warrant they hold the rights to Posted Content or have obtained necessary permissions, and obtain necessary consent from any persons appearing in photos.
  1. When a User uses the AI doodle feature, they consent to the relevant photos being sent to an external generative-AI service to provide that feature.
  1. We may delete, without prior notice, Posted Content we judge to be: against public order and morals; illegal or promoting illegal acts; defaming others or infringing others' rights; constituting or promoting child sexual abuse and exploitation (CSAE); constituting child sexual abuse material (CSAM); or otherwise inappropriate.

Article 7 (Group feature)

  1. Creating and joining albums is free for all Users. Joining is done via an invite URL or a QR code.
  1. The album owner is responsible for managing invite URLs/QR codes. Invited participants can view, edit, and save photos in the album. Guest Participants may only edit (doodle) and cannot add photos.
  1. Collaborative doodling is synced in real time. Users cannot delete doodles added by other participants (you may undo doodles you added yourself).
  1. Users use the group feature understanding that shared photos include other participants and subjects.

Article 8 (Child safety standards)

  1. Basic policy We position child safety as a top priority and make every effort to prevent child sexual abuse and exploitation (CSAE). Any content or act constituting CSAE is strictly prohibited.
  1. Prohibited content and acts The following are entirely prohibited: posting, sharing, storing, or distributing child sexual abuse material (CSAM); contacting minors for sexual exploitation (grooming); sextortion against minors; and any other act constituting sexual exploitation or abuse of minors.
  1. Response to CSAM If we discover CSAM, we immediately delete it, immediately suspend or permanently delete the relevant account, and report to authorities (police, Internet Hotline Center, etc.) under Japanese law.
  1. Legal compliance We comply with Japanese laws on child safety (the Act on Punishment of Activities Relating to Child Prostitution and Child Pornography, the Child Welfare Act, etc.) and review our operations as needed.

Article 9 (Reporting)

  1. Users finding inappropriate content or acts (including child-safety issues) may report via the in-app report feature or contact desk.
  1. We promptly investigate reported matters and take necessary measures; child-safety reports are handled with top priority.
  1. Users may also report child-safety issues directly to: Child Safety Contact — VAULT LLC, Child Safety Officer, safety@vault-tec.jp.

Article 10 (Prohibited acts)

Users must not: 1. impersonate others; 2. infringe others' IP, portrait rights, privacy, or other rights; 3. commit or promote illegal acts; 4. harass, threaten, or defame others; 5. make inappropriate posts (violent, obscene, discriminatory); 6. commit or aid CSAE; 7. post/share/store/distribute CSAM; 8. groom, sextort, or otherwise sexually exploit minors; 9. use the Service by falsifying age; 10. interfere with operation or illicitly access servers/systems; 11. do anything else we judge inappropriate.

Article 11 (Measures on violation)

  1. On violation, we may—with or without prior notice—delete Posted Content, suspend/permanently delete accounts, and report to authorities under law.
  1. For child-safety violations, upon discovery we immediately permanently delete the account and report to authorities.

Article 12 (Intellectual property)

  1. IP rights in the Service itself and the stickers, templates, effects, brand materials, and other materials it provides belong to us or rightful holders.
  1. Users may use photos created in the Service, personally or commercially (including posting to social media), within these Terms and applicable laws.
  1. Images exported on the free tier may bear our brand watermark and a QR code for joining the album.

Article 13 (Disclaimer)

  1. We do not warrant the Service is free from defects in fact or law (safety, reliability, accuracy, fitness for a particular purpose, etc.).
  1. We bear no responsibility for trouble between Users or between a User and a third party.
  1. We are not liable even if AI doodle or other generation results do not meet the User's expectations.
  1. Except for our intent or gross negligence, we are not liable for damages to Users regarding the Service.

Article 14 (Change/termination of the Service)

  1. We may change specifications, suspend, or terminate the Service without prior notice.
  1. We are not liable for damages to Users arising from such change or termination.

Article 15 (Governing law and jurisdiction)

  1. These Terms are governed by and construed under Japanese law.
  1. Disputes between Users and us relating to the Service are subject to the exclusive agreed jurisdiction of the Tokyo District Court as the court of first instance.

  1. 本服務包含多位使用者共同編輯一個相簿（照片）的群組功能。協作編輯即時同步。
  1. AI 塗鴉等部分功能在雲端伺服器及外部生成式 AI 服務上處理。
  1. 本服務以日本國內使用為前提。

第3條（對象使用者與年齡）

  1. 本服務面向 13 歲以上使用者。未滿 13 歲者不得使用。
  1. 未滿 18 歲使用者須經監護人同意後使用。
  1. 若查明不符合年齡要件，本公司有權停用或刪除該賬戶。

第4條（賬戶）

  1. 本服務的常規使用需通過“Sign in with Apple”或 Google 賬戶登入。
  1. 僅在通過邀請連結、QR 碼參與相簿時，方可作為不登入的匿名訪客參與者參與編輯。訪客參與者僅能進行塗鴉等編輯，不能新增照片。
  1. 訪客參與者可在之後登入以建立永久賬戶，將此前的參與資訊延續至同一賬戶。登入後可使用包括新增照片在內的功能。
  1. 登入用於在換機或重灌後延續購買、方案與資料。使用者應自行負責管理用於登入的 Apple ID 與 Google 賬戶。
  1. 使用者應自行負責管理顯示名稱、圖示及其他設定。
  1. 使用者可隨時於設定中刪除賬戶。已刪除的賬戶及相關資料無法恢復。

第5條（費用與付費）

  1. 本服務有免費範圍與付費方案（月費訂閱“Premium”）。各方案內容與價格顯示於 App 內。
  1. 付費通過 Apple App Store 或 Google Play 等應用內購處理。
  1. 月費方案除非取消否則自動續訂。取消請於應用商店的訂閱管理進行。
  1. 退款原則上依您所用應用商店的規定。
  1. AI 塗鴉等部分功能可在方案所含次數（點數）範圍內使用。點數每月重置，未使用部分不結轉至次月。
  1. 免費方案下，對自最後編輯起一定期間（目前為 45 天）無操作的相簿，編輯用的原始照片可能被自動刪除。已完成／匯出的影像將予以保留。期間及其他細節依 App 內與 FAQ，本公司可予變更。
  1. 本公司可變更費用或方案內容，變更將於 App 內公告。

第6條（投稿內容之處理）

  1. 使用者在本服務拍攝／匯入／創作的內容（“投稿內容”：照片、塗鴉、文字等）之權利歸屬使用者或正當權利人。
  1. 本公司得於提供／運營本服務所需範圍內（雲端保管與處理、照片的生成與匯出、向相簿參與者分享、為 AI 塗鴉向外部生成式 AI 服務傳送等）使用投稿內容。
  1. 使用者保證對投稿內容擁有權利或已取得必要授權，照片中出現他人時須取得必要同意。
  1. 使用者使用 AI 塗鴉功能時，同意相關照片等為提供該功能而被發送至外部生成式 AI 服務。
  1. 本公司得不經事先通知刪除其判斷屬於下列之投稿內容：違反公序良俗；違法或助長違法；誹謗他人或侵害他人權利；屬於或助長兒童性虐待與剝削（CSAE）；屬於兒童性虐待內容（CSAM）；其他本公司認定不當之內容。

第7條（群組功能）

  1. 相簿的建立與參與，所有使用者皆可免費使用。參與通過邀請連結或 QR 碼進行。
  1. 相簿擁有者須負責管理邀請連結／QR 碼。受邀參與者可閱覽、編輯與儲存相簿內的照片。訪客參與者僅能編輯（塗鴉），不能新增照片。
  1. 協作塗鴉即時同步。使用者不能刪除其他參與者所加的塗鴉（可撤銷自己所加的塗鴉）。
  1. 使用者在理解相簿內分享的照片包含其他參與者與被攝者後，使用群組功能。

第8條（兒童安全基準）

  1. 基本方針 本公司將兒童安全列為最優先，全力防止兒童性虐待與剝削（CSAE）。嚴格禁止任何構成 CSAE 之內容與行為。
  1. 禁止之內容與行為 一律禁止：張貼、分享、儲存或散佈兒童性虐待內容（CSAM）；以性剝削為目的接觸未成年人（誘騙 grooming）；對未成年人之性勒索（sextortion）；其他對未成年人之性剝削或虐待行為。
  1. 對 CSAM 之處置 發現 CSAM 時，本公司立即刪除該內容、立即停用或永久刪除相關賬戶，並依日本法令向相關當局（警方、網路熱線中心等）通報。
  1. 法令遵循 本公司遵循日本國內兒童安全相關法令，並視需要檢討運營體制。

第9條（通報）

  1. 使用者發現不當內容或行為（含兒童安全問題）時，可通過 App 內檢舉功能或客服視窗向本公司通報。
  1. 本公司就受理之通報迅速調查並採取必要措施；兒童安全通報以最優先處理。
  1. 兒童安全問題亦可直接通報至：兒童安全客服視窗 — VAULT LLC 兒童安全負責人，safety@vault-tec.jp。

第10條（禁止事項）

使用者不得：1. 冒充他人；2. 侵害他人智慧財產權、肖像權、隱私或其他權利；3. 從事或助長違法行為；4. 騷擾、脅迫、誹謗他人；5. 不當張貼（暴力、猥褻、歧視）；6. 構成或幫助 CSAE 之行為；7. 張貼／分享／儲存／散佈 CSAM；8. 對未成年人之誘騙、性勒索或其他性剝削行為；9. 偽報年齡使用本服務；10. 妨礙運營或不正訪問伺服器／系統；11. 其他本公司認定不當之行為。

第11條（違反時之措施）

  1. 使用者違反本條款時，本公司不論有無事先通知，得刪除投稿內容、暫停／永久刪除賬戶、依法令向當局通報等。
  1. 就兒童安全之違反，一經發覺即立即永久刪除賬戶並向當局通報。

第12條（智慧財產權）

  1. 本服務本身及其提供之貼紙、模板、特效、品牌素材等素材之智慧財產權，歸屬本公司或正當權利人。
  1. 使用者得於本條款及相關法令範圍內，個人或商業（含張貼至社群）使用所創作之照片。
  1. 以免費方案匯出的影像，可能帶有本公司品牌水印及加入相簿用的 QR 碼。

第13條（免責事項）

  1. 本公司不保證本服務在事實上或法律上無瑕疵（安全性、可靠性、正確性、特定目的適合性等）。
  1. 對於使用者間或使用者與第三人間之糾紛，本公司不負任何責任。
  1. 即使 AI 塗鴉等生成結果不符使用者期待，本公司亦不負責。
  1. 除本公司故意或重大過失外，對於使用者就本服務所生之損害，本公司不負責任。

第14條（服務之變更與終止）

  1. 本公司得不經事先通知，變更本服務規格、中止或終止提供。
  1. 對於因該變更或終止致用戶所生之損害，本公司不負責任。

第15條（準據法與管轄）

  1. 本條款之解釋與適用以日本法為準據。
  1. 與本服務相關之使用者與本公司間爭議，以東京地方裁判所為第一審專屬合意管轄法院。

제1조 (적용)

제2조 (개요)

  1. 본 서비스는 이용자가 촬영하거나 가져온 사진을 그리드에 배치하고, 펜·텍스트·이모지·스티커·AI 가공 등의 낙서를 더해 한 장의 사진을 제작·저장·공유할 수 있는 사진 서비스입니다.
  1. 본 서비스에는 여러 이용자가 하나의 앨범(사진)을 공동 편집하는 그룹 기능이 포함됩니다. 공동 편집은 실시간으로 동기화됩니다.
  1. AI 낙서 등 일부 기능은 클라우드 서버 및 외부 생성형 AI 서비스에서 처리됩니다.
  1. 본 서비스는 일본 국내 이용을 전제로 합니다.

제3조 (대상 이용자·연령)

  1. 본 서비스는 만 13세 이상을 대상으로 합니다. 13세 미만은 이용할 수 없습니다.
  1. 18세 미만 이용자는 보호자의 동의를 받아 이용해야 합니다.
  1. 연령 요건 미충족이 확인되면 당사는 해당 계정을 정지 또는 삭제할 수 있습니다.

제4조 (계정)

  1. 본 서비스의 일반적인 이용에는 Apple의 "Sign in with Apple" 또는 Google 계정 로그인이 필요합니다.
  1. 초대 URL·QR 코드를 통해 앨범에 참여하는 경우에 한해, 로그인하지 않는 익명의 게스트 참가자로서 편집에 참여할 수 있습니다. 게스트 참가자는 낙서 등 편집만 할 수 있으며 사진을 추가할 수 없습니다.
  1. 게스트 참가자는 이후 로그인하여 영구 계정을 만들면 그동안의 참여 정보를 동일 계정으로 이어갈 수 있습니다. 로그인 후에는 사진 추가를 포함한 기능을 이용할 수 있습니다.
  1. 로그인은 기기 변경·재설치 후에도 구매·플랜 및 데이터를 이어가기 위해 사용됩니다. 이용자는 로그인에 사용하는 Apple ID와 Google 계정을 본인 책임으로 관리합니다.
  1. 이용자는 표시 이름·아이콘 등 설정을 본인 책임으로 관리합니다.
  1. 이용자는 설정에서 언제든지 계정을 삭제할 수 있으며, 삭제된 계정과 관련 데이터는 복구할 수 없습니다.

제5조 (요금·결제)

  1. 본 서비스에는 무료 범위와 유료 플랜(월정액 구독 "Premium")이 있습니다. 플랜 내용과 가격은 앱에 표시됩니다.
  1. 결제는 Apple App Store 또는 Google Play 등 앱 내 구매로 처리됩니다.
  1. 월정액 플랜은 해지하지 않는 한 자동 갱신됩니다. 해지는 앱스토어 구독 관리에서 합니다.
  1. 환불은 원칙적으로 이용 중인 앱스토어 규정을 따릅니다.
  1. AI 낙서 등 일부 기능은 플랜에 포함된 횟수(크레딧) 범위에서 이용할 수 있습니다. 크레딧은 매월 초기화되며 미사용분은 다음 달로 이월되지 않습니다.
  1. 무료 플랜에서는 마지막 편집 후 일정 기간(현재 45일) 조작이 없는 앨범의 편집용 원본 사진이 자동 삭제될 수 있습니다. 완성·내보낸 이미지는 계속 보관됩니다. 기간 등 세부 사항은 앱 및 FAQ를 따르며 당사가 변경할 수 있습니다.
  1. 당사는 요금·플랜 내용을 변경할 수 있으며, 변경은 앱에서 고지합니다.

제6조 (게시 콘텐츠 취급)

  1. 이용자가 본 서비스에서 촬영·가져오기·제작한 콘텐츠("게시 콘텐츠": 사진·낙서·텍스트 등)의 권리는 이용자 또는 정당한 권리자에게 귀속됩니다.
  1. 당사는 서비스 제공·운영에 필요한 범위(클라우드 보관·처리, 사진 생성·내보내기, 앨범 참가자 공유, AI 낙서를 위한 외부 생성형 AI 서비스로의 전송 등)에서 게시 콘텐츠를 사용할 수 있습니다.
  1. 이용자는 게시 콘텐츠에 대한 권리 보유 또는 필요한 허락 취득을 보증하며, 사진에 타인이 있는 경우 필요한 동의를 받습니다.
  1. 이용자가 AI 낙서 기능을 이용하는 경우, 대상 사진 등이 해당 기능 제공을 위해 외부 생성형 AI 서비스로 전송되는 것에 동의합니다.
  1. 당사는 다음에 해당한다고 판단한 게시 콘텐츠를 사전 통지 없이 삭제할 수 있습니다: 공서양속 위반; 위법 또는 위법 조장; 타인 비방 또는 권리 침해; 아동 성착취·학대(CSAE) 해당 또는 조장; 아동 성학대 콘텐츠(CSAM) 해당; 기타 부적절하다고 판단한 내용.

제7조 (그룹 기능)

  1. 앨범의 생성 및 참여는 모든 이용자가 무료로 이용할 수 있습니다. 참여는 초대 URL 또는 QR 코드를 통해 이루어집니다.
  1. 앨범 오너는 초대 URL·QR 코드 관리 책임을 집니다. 초대받은 참가자는 앨범 내 사진을 열람·편집·저장할 수 있습니다. 게스트 참가자는 편집(낙서)만 할 수 있으며 사진을 추가할 수 없습니다.
  1. 협동 낙서는 실시간으로 동기화됩니다. 이용자는 다른 참가자가 더한 낙서를 삭제할 수 없습니다(자신이 더한 낙서의 취소는 가능합니다).
  1. 이용자는 앨범에서 공유되는 사진에 다른 참가자나 피사체가 포함됨을 이해하고 그룹 기능을 이용합니다.

제8조 (아동 안전 기준)

  1. 기본 방침 당사는 아동 안전을 최우선으로 두고 아동 성착취·학대(CSAE) 방지에 전력을 다합니다. CSAE에 해당하는 모든 콘텐츠·행위를 엄격히 금지합니다.
  1. 금지 콘텐츠·행위 다음을 일절 금지합니다: 아동 성학대 콘텐츠(CSAM)의 게시·공유·보관·배포; 성착취 목적의 미성년자 접촉(그루밍); 미성년자 대상 섹스토션; 기타 미성년자 성착취·학대 행위.
  1. CSAM 대응 CSAM 발견 시 즉시 해당 콘텐츠를 삭제하고 관련 계정을 즉시 정지 또는 영구 삭제하며, 일본 법령에 따라 관계 당국(경찰, 인터넷 핫라인 센터 등)에 신고합니다.
  1. 법령 준수 당사는 아동 안전 관련 일본 법령을 준수하고 필요에 따라 운영 체계를 점검합니다.

제9조 (신고)

  1. 이용자는 부적절한 콘텐츠·행위(아동 안전 문제 포함) 발견 시 앱 내 신고 기능 또는 문의 창구로 보고할 수 있습니다.
  1. 당사는 신고 사안을 신속히 조사하고 필요한 조치를 취하며, 아동 안전 신고는 최우선 대응합니다.
  1. 아동 안전 문제는 다음으로도 직접 신고할 수 있습니다: 아동 안전 문의 창구 — VAULT LLC 아동안전 담당, safety@vault-tec.jp.

제10조 (금지 사항)

이용자는 다음을 해서는 안 됩니다: 1. 타인 사칭; 2. 타인의 지식재산권·초상권·프라이버시 등 권리 침해; 3. 위법 또는 위법 조장; 4. 괴롭힘·협박·비방; 5. 부적절한 게시(폭력·음란·차별); 6. CSAE 해당 또는 방조; 7. CSAM 게시·공유·보관·배포; 8. 미성년자 그루밍·섹스토션 등 성착취; 9. 연령을 속인 이용; 10. 운영 방해 또는 서버·시스템 부정 접근; 11. 기타 당사가 부적절하다고 판단하는 행위.

제11조 (위반 시 조치)

  1. 위반 시 당사는 사전 통지 여부와 무관하게 게시 콘텐츠 삭제, 계정 정지·영구 삭제, 법령에 따른 당국 신고 등의 조치를 취할 수 있습니다.
  1. 아동 안전 위반은 발각 즉시 계정을 영구 삭제하고 당국에 신고합니다.

제12조 (지식재산권)

  1. 본 서비스 자체 및 제공되는 스티커·템플릿·이펙트·브랜드 소재 등 소재의 지식재산권은 당사 또는 정당한 권리자에게 귀속됩니다.
  1. 이용자는 본 서비스에서 제작한 사진을 본 약관과 관련 법령 범위에서 개인·상업 불문 이용(SNS 게시 포함)할 수 있습니다.
  1. 무료 플랜으로 내보낸 이미지에는 당사 브랜드 워터마크 및 앨범 참여용 QR 코드가 부여될 수 있습니다.

제13조 (면책)

  1. 당사는 본 서비스에 사실상·법률상 하자(안전성·신뢰성·정확성·특정 목적 적합성 등)가 없음을 보증하지 않습니다.
  1. 이용자 간 또는 이용자와 제3자 간 분쟁에 대해 당사는 책임지지 않습니다.
  1. AI 낙서 등 생성 결과가 이용자의 기대에 부합하지 않아도 당사는 책임지지 않습니다.
  1. 당사의 고의 또는 중과실의 경우를 제외하고, 본 서비스 관련 이용자 손해에 대해 당사는 책임지지 않습니다.

제14조 (서비스 변경·종료)

  1. 당사는 사전 통지 없이 본 서비스의 사양 변경, 제공 중지 또는 종료를 할 수 있습니다.
  1. 변경 또는 종료로 이용자에게 발생한 손해에 대해 당사는 책임지지 않습니다.

제15조 (준거법·관할)

  1. 본 약관의 해석·적용은 일본법을 따릅니다.

Artículo 1 (Aplicación)

  1. Estos Términos se aplican a toda relación entre los Usuarios y nosotros respecto al uso del Servicio.
  1. Podemos modificar estos Términos. Los Términos modificados se consideran aceptados cuando el Usuario continúa usando el Servicio tras su anuncio en el Servicio.

Con independencia de si instalan la app o inician sesión, quienes se unan a la edición colaborativa de un álbum mediante un navegador u otros medios a través de una URL de invitación, código QR, etc., y realicen ediciones como garabatos ("Participantes Invitados"), también se incluyen en los "Usuarios" de estos Términos y se consideran aceptantes al momento de unirse o editar.

Artículo 2 (Descripción)

  1. El Servicio es un servicio de fotos que permite a los Usuarios colocar en una cuadrícula las fotos que toman o importan, añadir garabatos (lápiz, texto, emojis, stickers, ediciones con IA, etc.) y crear, guardar y compartir una única foto.
  1. El Servicio incluye una función de grupo donde varios Usuarios editan en colaboración un álbum (foto). La edición colaborativa se sincroniza en tiempo real.
  1. Algunas funciones, como los garabatos con IA, se procesan en servidores en la nube y en servicios externos de IA generativa.
  1. El Servicio está destinado al uso dentro de Japón.

Artículo 3 (Usuarios y edad)

  1. El Servicio es para mayores de 13 años. Los menores de 13 no pueden usarlo.
  1. Los menores de 18 deben usar el Servicio con el consentimiento de un tutor.
  1. Si se detecta que un Usuario no cumple el requisito de edad, podemos suspender o eliminar esa cuenta.

Artículo 4 (Cuenta)

  1. El uso normal del Servicio requiere iniciar sesión con "Sign in with Apple" o una cuenta de Google.
  1. Solo al unirse a un álbum mediante una URL de invitación o un código QR se puede participar en la edición como Participante Invitado anónimo sin iniciar sesión. Los Participantes Invitados solo pueden editar (p. ej., garabatear) y no pueden añadir fotos.
  1. Un Participante Invitado puede iniciar sesión después para crear una cuenta permanente, trasladando sus datos de participación previos a la misma cuenta. Tras iniciar sesión, puede usar funciones que incluyen añadir fotos.
  1. El inicio de sesión sirve para conservar compras, planes y datos al cambiar de dispositivo o reinstalar. Los Usuarios gestionan bajo su responsabilidad el Apple ID y la cuenta de Google usados para iniciar sesión.
  1. Los Usuarios gestionan su nombre visible, icono y otros ajustes bajo su responsabilidad.
  1. Los Usuarios pueden eliminar su cuenta cuando quieran desde Ajustes. Las cuentas eliminadas y sus datos no se pueden restaurar.

Artículo 5 (Tarifas y pagos)

  1. El Servicio tiene un nivel gratuito y un plan de pago (la suscripción mensual "Premium"). El contenido y los precios se muestran en la app.
  1. El cobro se procesa mediante compra dentro de la app, como Apple App Store o Google Play.
  1. Los planes mensuales se renuevan automáticamente salvo cancelación. Cancela desde la gestión de suscripciones de tu tienda.
  1. Los reembolsos siguen, en principio, las normas de tu tienda.
  1. Algunas funciones, como los garabatos con IA, están disponibles dentro del número de veces (créditos) incluido en tu plan. Los créditos se reinician mensualmente y los no usados no se acumulan al mes siguiente.
  1. En el nivel gratuito, para los álbumes sin actividad durante un cierto periodo tras la última edición (actualmente 45 días), las fotos originales usadas para editar pueden eliminarse automáticamente. Las imágenes completadas/exportadas se conservan. El periodo y demás detalles siguen la app y las FAQ, y podemos cambiarlos.
  1. Podemos cambiar tarifas o contenidos de planes; los cambios se anuncian en la app.

Artículo 6 (Contenido publicado)

  1. Los derechos del contenido que el Usuario toma/importa/crea ("Contenido publicado": fotos, garabatos, texto, etc.) pertenecen al Usuario o al titular legítimo.
  1. Podemos usar el Contenido publicado en la medida necesaria para prestar/operar el Servicio (almacenamiento/procesamiento en la nube, generación/exportación de fotos, compartir con participantes del álbum, envío a servicios externos de IA generativa para garabatos con IA, etc.).
  1. Los Usuarios garantizan tener los derechos o las autorizaciones necesarias y obtener el consentimiento de las personas que aparezcan en las fotos.
  1. Cuando un Usuario usa la función de garabato con IA, consiente que las fotos correspondientes se envíen a un servicio externo de IA generativa para prestar esa función.
  1. Podemos eliminar sin previo aviso el Contenido publicado que consideremos: contrario al orden público y la moral; ilegal o que fomente actos ilegales; difamatorio o que infrinja derechos de terceros; que constituya o fomente el abuso y la explotación sexual infantil (CSAE); que constituya material de abuso sexual infantil (CSAM); o inapropiado por otros motivos.

Artículo 7 (Función de grupo)

  1. Crear álbumes y unirse a ellos es gratuito para todos los Usuarios. La participación se realiza mediante una URL de invitación o un código QR.
  1. El propietario del álbum es responsable de gestionar las URL/QR de invitación. Los participantes invitados pueden ver, editar y guardar las fotos del álbum. Los Participantes Invitados solo pueden editar (garabatear) y no pueden añadir fotos.
  1. El garabateo colaborativo se sincroniza en tiempo real. Los Usuarios no pueden eliminar los garabatos añadidos por otros participantes (puedes deshacer los que tú añadiste).
  1. Los Usuarios usan la función de grupo entendiendo que las fotos compartidas incluyen a otros participantes y personas retratadas.

Artículo 8 (Normas de seguridad infantil)

  1. Política básica Situamos la seguridad infantil como máxima prioridad y nos esforzamos por prevenir el abuso y la explotación sexual infantil (CSAE). Todo contenido o acto que constituya CSAE está estrictamente prohibido.
  1. Contenido y actos prohibidos Se prohíbe por completo: publicar, compartir, almacenar o distribuir material de abuso sexual infantil (CSAM); contactar a menores con fines de explotación sexual (grooming); la sextorsión a menores; y cualquier otro acto de explotación o abuso sexual de menores.
  1. Respuesta ante CSAM Si detectamos CSAM, lo eliminamos de inmediato, suspendemos o eliminamos permanentemente la cuenta y lo denunciamos a las autoridades (policía, Internet Hotline Center, etc.) conforme a la ley japonesa.
  1. Cumplimiento legal Cumplimos las leyes japonesas sobre seguridad infantil y revisamos nuestras operaciones según sea necesario.

Artículo 9 (Denuncias)

  1. Los Usuarios que encuentren contenido o actos inapropiados (incluida la seguridad infantil) pueden denunciarlo mediante la función de denuncia de la app o el contacto.

Artículo 10 (Actos prohibidos)

Los Usuarios no deben: 1. suplantar a otros; 2. infringir la PI, derechos de imagen, privacidad u otros derechos; 3. cometer o fomentar actos ilegales; 4. acosar, amenazar o difamar; 5. hacer publicaciones inapropiadas (violentas, obscenas, discriminatorias); 6. cometer o ayudar al CSAE; 7. publicar/compartir/almacenar/distribuir CSAM; 8. grooming, sextorsión u otra explotación sexual de menores; 9. usar el Servicio falsificando la edad; 10. interferir en la operación o acceder ilícitamente a servidores/sistemas; 11. cualquier otro acto que consideremos inapropiado.

Artículo 11 (Medidas ante infracciones)

  1. Ante una infracción, podemos —con o sin aviso previo— eliminar Contenido publicado, suspender/eliminar cuentas y denunciar a las autoridades conforme a la ley.
  1. Ante infracciones de seguridad infantil, al detectarlas eliminamos permanentemente la cuenta y lo denunciamos de inmediato.

Artículo 12 (Propiedad intelectual)

  1. Los derechos de PI del propio Servicio y de los stickers, plantillas, efectos, materiales de marca y demás materiales que ofrece pertenecen a nosotros o a sus titulares legítimos.
  1. Los Usuarios pueden usar las fotos creadas en el Servicio, de forma personal o comercial (incluida la publicación en redes), dentro de estos Términos y la ley aplicable.
  1. Las imágenes exportadas en el nivel gratuito pueden llevar nuestra marca de agua y un código QR para unirse al álbum.

Artículo 13 (Exención de responsabilidad)

  1. No garantizamos que el Servicio esté libre de defectos de hecho o de derecho (seguridad, fiabilidad, exactitud, idoneidad para un fin concreto, etc.).
  1. No asumimos responsabilidad por problemas entre Usuarios o entre un Usuario y un tercero.
  1. No somos responsables aunque los resultados de los garabatos con IA u otra generación no cumplan las expectativas del Usuario.
  1. Salvo dolo o negligencia grave nuestra, no respondemos por daños a los Usuarios relacionados con el Servicio.

Artículo 14 (Cambio/terminación del Servicio)

  1. Podemos cambiar especificaciones, suspender o terminar el Servicio sin previo aviso.
  1. No respondemos por daños a los Usuarios derivados de dicho cambio o terminación.

Artículo 15 (Ley aplicable y jurisdicción)

  1. Estos Términos se rigen e interpretan conforme a la ley japonesa.
  1. Las disputas relativas al Servicio se someten a la jurisdicción exclusiva acordada del Tribunal de Distrito de Tokio como primera instancia.

  1. O uso normal do Serviço requer login com "Sign in with Apple" ou uma conta Google.
  1. Somente ao ingressar em um álbum por URL de convite ou código QR é possível participar da edição como Participante Convidado anônimo sem fazer login. Participantes Convidados só podem editar (p. ex., rabiscar) e não podem adicionar fotos.
  1. Um Participante Convidado pode fazer login depois para criar uma conta permanente, transferindo seus dados de participação anteriores para a mesma conta. Após o login, pode usar recursos que incluem adicionar fotos.
  1. O login serve para manter compras, planos e dados ao trocar de dispositivo ou reinstalar. Os Usuários gerenciam, sob sua responsabilidade, o Apple ID e a conta Google usados para login.
  1. Os Usuários gerenciam o nome de exibição, ícone e outras configurações sob sua responsabilidade.
  1. Os Usuários podem excluir a conta a qualquer momento nas Configurações. Contas excluídas e dados relacionados não podem ser restaurados.

Artigo 5 (Tarifas e cobrança)

  1. O Serviço tem nível gratuito e um plano pago (a assinatura mensal "Premium"). Conteúdos e preços são exibidos no app.
  1. A cobrança é processada por compra no app, como Apple App Store ou Google Play.
  1. Planos mensais renovam automaticamente salvo cancelamento. Cancele na gestão de assinaturas da sua loja.
  1. Reembolsos seguem, em princípio, as regras da sua loja.
  1. Alguns recursos, como rabiscos com IA, estão disponíveis dentro do número de vezes (créditos) incluído no seu plano. Os créditos são reiniciados mensalmente e os não usados não passam para o mês seguinte.
  1. No nível gratuito, para álbuns sem atividade por um certo período após a última edição (atualmente 45 dias), as fotos originais usadas para edição podem ser excluídas automaticamente. Imagens concluídas/exportadas são mantidas. O período e demais detalhes seguem o app e as FAQ e podem ser alterados por nós.
  1. Podemos alterar tarifas ou conteúdos de planos; alterações são anunciadas no app.

Artigo 6 (Conteúdo publicado)

  1. Os direitos do conteúdo que o Usuário tira/importa/cria ("Conteúdo publicado": fotos, rabiscos, texto, etc.) pertencem ao Usuário ou ao titular legítimo.
  1. Podemos usar o Conteúdo publicado na medida necessária para prestar/operar o Serviço (armazenamento/processamento em nuvem, geração/exportação de fotos, compartilhamento com participantes do álbum, envio a serviços externos de IA generativa para rabiscos com IA, etc.).
  1. Os Usuários garantem deter os direitos ou autorizações necessárias e obter o consentimento de pessoas que apareçam nas fotos.
  1. Quando um Usuário usa o recurso de rabisco com IA, consente que as fotos correspondentes sejam enviadas a um serviço externo de IA generativa para prestar esse recurso.
  1. Podemos excluir sem aviso prévio Conteúdo que julgarmos: contrário à ordem pública e aos bons costumes; ilegal ou que incentive atos ilegais; difamatório ou que viole direitos de terceiros; que constitua ou incentive abuso e exploração sexual infantil (CSAE); que constitua material de abuso sexual infantil (CSAM); ou inapropriado por outros motivos.

Artigo 7 (Recurso de grupo)

  1. Criar álbuns e entrar neles é gratuito para todos os Usuários. A participação é feita por meio de uma URL de convite ou código QR.
  1. O dono do álbum é responsável por gerir as URLs/QR de convite. Participantes convidados podem ver, editar e salvar as fotos do álbum. Participantes Convidados só podem editar (rabiscar) e não podem adicionar fotos.
  1. O rabisco colaborativo é sincronizado em tempo real. Os Usuários não podem excluir rabiscos adicionados por outros participantes (você pode desfazer os que você mesmo adicionou).
  1. Os Usuários usam o recurso de grupo cientes de que as fotos compartilhadas incluem outros participantes e pessoas retratadas.

Artigo 8 (Normas de segurança infantil)

  1. Política básica Colocamos a segurança infantil como prioridade máxima e nos empenhamos em prevenir o abuso e a exploração sexual infantil (CSAE). Todo conteúdo ou ato que constitua CSAE é estritamente proibido.
  1. Conteúdo e atos proibidos É totalmente proibido: publicar, compartilhar, armazenar ou distribuir material de abuso sexual infantil (CSAM); contatar menores para exploração sexual (aliciamento); sextorsão contra menores; e qualquer outro ato de exploração ou abuso sexual de menores.
  1. Resposta a CSAM Ao detectar CSAM, excluímos imediatamente, suspendemos ou excluímos permanentemente a conta e denunciamos às autoridades (polícia, Internet Hotline Center, etc.) conforme a lei japonesa.
  1. Conformidade legal Cumprimos as leis japonesas de segurança infantil e revisamos nossas operações conforme necessário.

Artigo 9 (Denúncias)

  1. Usuários que encontrem conteúdo ou atos inapropriados (inclusive de segurança infantil) podem denunciar pelo recurso de denúncia do app ou pelo contato.
  1. Investigamos prontamente e tomamos as medidas necessárias; denúncias de segurança infantil têm prioridade máxima.
  1. Problemas de segurança infantil também podem ser denunciados diretamente a: Contato de Segurança Infantil — VAULT LLC, Responsável de Segurança Infantil, safety@vault-tec.jp.

Artigo 10 (Atos proibidos)

Os Usuários não devem: 1. passar-se por outros; 2. violar PI, direitos de imagem, privacidade ou outros direitos; 3. cometer ou incentivar atos ilegais; 4. assediar, ameaçar ou difamar; 5. fazer publicações inapropriadas (violentas, obscenas, discriminatórias); 6. cometer ou auxiliar CSAE; 7. publicar/compartilhar/armazenar/distribuir CSAM; 8. aliciamento, sextorsão ou outra exploração sexual de menores; 9. usar o Serviço falsificando a idade; 10. interferir na operação ou acessar ilicitamente servidores/sistemas; 11. qualquer outro ato que julgarmos inapropriado.

Artigo 11 (Medidas em caso de violação)

  1. Em caso de violação, podemos—com ou sem aviso prévio—excluir Conteúdo, suspender/excluir contas e denunciar às autoridades conforme a lei.
  1. Em violações de segurança infantil, ao detectá-las excluímos permanentemente a conta e denunciamos imediatamente.

Artigo 12 (Propriedade intelectual)

  1. Os direitos de PI do próprio Serviço e dos stickers, modelos, efeitos, materiais de marca e demais materiais oferecidos pertencem a nós ou aos titulares legítimos.
  1. Os Usuários podem usar as fotos criadas no Serviço, pessoal ou comercialmente (inclusive publicação em redes), dentro destes Termos e da lei aplicável.
  1. As imagens exportadas no nível gratuito podem trazer nossa marca d'água e um código QR para entrar no álbum.

Artigo 13 (Isenção de responsabilidade)

  1. Não garantimos que o Serviço esteja livre de defeitos de fato ou de direito (segurança, confiabilidade, exatidão, adequação a uma finalidade específica, etc.).
  1. Não nos responsabilizamos por problemas entre Usuários ou entre Usuário e terceiros.
  1. Não somos responsáveis ainda que os resultados de rabiscos com IA ou outra geração não atendam às expectativas do Usuário.
  1. Salvo dolo ou culpa grave nossa, não respondemos por danos a Usuários relacionados ao Serviço.

Artigo 14 (Alteração/encerramento do Serviço)

  1. Podemos alterar especificações, suspender ou encerrar o Serviço sem aviso prévio.
  1. Não respondemos por danos a Usuários decorrentes de tal alteração ou encerramento.

Artigo 15 (Lei aplicável e foro)

  1. Estes Termos regem-se e interpretam-se pela lei japonesa.
  1. Disputas relativas ao Serviço sujeitam-se ao foro exclusivo acordado do Tribunal Distrital de Tóquio como primeira instância.

Ketentuan Layanan ini ("Ketentuan") mengatur syarat penggunaan "picmi" ("Layanan") yang disediakan oleh VAULT LLC (合同会社VAULT; "kami"). Semua pengguna ("Pengguna") menggunakan Layanan dengan menyetujui Ketentuan ini.

Pasal 1 (Penerapan)

  1. Ketentuan ini berlaku untuk seluruh hubungan antara Pengguna dan kami terkait penggunaan Layanan.
  1. Kami dapat mengubah Ketentuan ini. Ketentuan yang diubah dianggap disetujui ketika Pengguna terus menggunakan Layanan setelah pengumuman di Layanan.
  1. Terlepas dari apakah memasang aplikasi atau masuk, siapa pun yang bergabung ke pengeditan album secara kolaboratif melalui browser atau cara lain via URL undangan, kode QR, dll., dan melakukan pengeditan seperti coretan ("Peserta Tamu") juga termasuk dalam "Pengguna" menurut Ketentuan ini, dan dianggap menyetujui pada saat bergabung atau mengedit.

Pasal 2 (Gambaran)

  1. Layanan adalah layanan foto yang memungkinkan Pengguna menata foto yang diambil atau diimpor ke dalam kisi, menambahkan coretan (pena, teks, emoji, stiker, suntingan AI, dll.), dan membuat, menyimpan, serta membagikan satu foto.
  1. Layanan mencakup fitur grup di mana beberapa Pengguna mengedit satu album (foto) bersama. Pengeditan kolaboratif disinkronkan secara real time.
  1. Beberapa fitur, seperti coretan AI, diproses di server cloud dan layanan AI generatif eksternal.
  1. Layanan ditujukan untuk penggunaan di dalam Jepang.

Pasal 3 (Pengguna dan usia)

  1. Layanan untuk pengguna berusia 13 tahun ke atas. Di bawah 13 tahun tidak boleh memakainya.
  1. Pengguna di bawah 18 tahun harus memakai Layanan dengan persetujuan wali.
  1. Jika diketahui Pengguna tidak memenuhi syarat usia, kami dapat menangguhkan atau menghapus akun tersebut.

Pasal 4 (Akun)

  1. Penggunaan normal Layanan memerlukan masuk dengan "Sign in with Apple" atau akun Google.
  1. Hanya saat bergabung ke album melalui URL undangan atau kode QR Anda dapat ikut mengedit sebagai Peserta Tamu anonim tanpa masuk. Peserta Tamu hanya dapat mengedit (mis. mencoret) dan tidak dapat menambahkan foto.
  1. Peserta Tamu dapat masuk kemudian untuk membuat akun permanen, memindahkan data partisipasi sebelumnya ke akun yang sama. Setelah masuk, dapat memakai fitur termasuk menambahkan foto.
  1. Masuk digunakan untuk membawa pembelian, paket, dan data saat ganti perangkat atau pasang ulang. Pengguna mengelola Apple ID dan akun Google yang dipakai untuk masuk atas tanggung jawab sendiri.
  1. Pengguna mengelola nama tampilan, ikon, dan pengaturan lain atas tanggung jawab sendiri.
  1. Pengguna dapat menghapus akun kapan saja dari Pengaturan. Akun yang dihapus dan datanya tidak dapat dipulihkan.

Pasal 5 (Biaya dan pembayaran)

  1. Layanan memiliki tingkat gratis dan paket berbayar (langganan bulanan "Premium"). Isi dan harga paket ditampilkan di aplikasi.
  1. Pembayaran diproses melalui pembelian dalam aplikasi, seperti Apple App Store atau Google Play.
  1. Paket bulanan diperpanjang otomatis kecuali dibatalkan. Batalkan dari pengelolaan langganan toko Anda.
  1. Pengembalian dana pada prinsipnya mengikuti aturan toko Anda.
  1. Beberapa fitur, seperti coretan AI, tersedia dalam jumlah (kredit) yang termasuk dalam paket Anda. Kredit diatur ulang setiap bulan dan yang tidak terpakai tidak dibawa ke bulan berikutnya.
  1. Pada tingkat gratis, untuk album tanpa aktivitas selama periode tertentu setelah pengeditan terakhir (saat ini 45 hari), foto asli yang digunakan untuk mengedit dapat dihapus otomatis. Gambar yang selesai/diekspor tetap disimpan. Periode dan detail lain mengikuti aplikasi dan FAQ serta dapat kami ubah.
  1. Kami dapat mengubah biaya atau isi paket; perubahan diumumkan di aplikasi.

Pasal 6 (Konten yang diunggah)

  1. Hak atas konten yang Pengguna ambil/impor/buat ("Konten": foto, coretan, teks, dll.) milik Pengguna atau pemegang hak yang sah.
  1. Kami dapat menggunakan Konten sebatas yang diperlukan untuk menyediakan/mengoperasikan Layanan (penyimpanan/pemrosesan cloud, pembuatan/ekspor foto, berbagi dengan peserta album, pengiriman ke layanan AI generatif eksternal untuk coretan AI, dll.).
  1. Pengguna menjamin memiliki hak atau izin yang diperlukan, dan memperoleh persetujuan dari orang yang tampil di foto.
  1. Saat Pengguna memakai fitur coretan AI, ia menyetujui foto terkait dikirim ke layanan AI generatif eksternal untuk menyediakan fitur tersebut.
  1. Kami dapat menghapus tanpa pemberitahuan Konten yang kami nilai: melanggar ketertiban umum dan kesusilaan; ilegal atau mendorong tindakan ilegal; mencemarkan nama baik atau melanggar hak orang lain; merupakan atau mendorong pelecehan dan eksploitasi seksual anak (CSAE); merupakan materi pelecehan seksual anak (CSAM); atau tidak pantas karena alasan lain.

Pasal 7 (Fitur grup)

  1. Membuat dan bergabung ke album gratis untuk semua Pengguna. Bergabung dilakukan melalui URL undangan atau kode QR.
  1. Pemilik album bertanggung jawab mengelola URL/QR undangan. Peserta yang diundang dapat melihat, mengedit, dan menyimpan foto dalam album. Peserta Tamu hanya dapat mengedit (mencoret) dan tidak dapat menambahkan foto.
  1. Mencoret secara kolaboratif disinkronkan real time. Pengguna tidak dapat menghapus coretan yang ditambahkan peserta lain (Anda dapat membatalkan coretan yang Anda tambahkan sendiri).
  1. Pengguna memakai fitur grup dengan memahami bahwa foto yang dibagikan memuat peserta lain dan orang yang difoto.

Pasal 8 (Standar keselamatan anak)

  1. Kebijakan dasar Kami menempatkan keselamatan anak sebagai prioritas utama dan berupaya penuh mencegah pelecehan dan eksploitasi seksual anak (CSAE). Setiap konten atau tindakan CSAE dilarang keras.
  1. Konten dan tindakan terlarang Dilarang sepenuhnya: mengunggah, membagikan, menyimpan, atau menyebarkan materi pelecehan seksual anak (CSAM); menghubungi anak untuk eksploitasi seksual (grooming); sekstorsi terhadap anak; dan tindakan eksploitasi atau pelecehan seksual anak lainnya.
  1. Penanganan CSAM Jika menemukan CSAM, kami segera menghapusnya, menangguhkan atau menghapus permanen akun terkait, dan melaporkan ke otoritas (polisi, Internet Hotline Center, dll.) sesuai hukum Jepang.
  1. Kepatuhan hukum Kami mematuhi hukum Jepang tentang keselamatan anak dan meninjau operasi sesuai kebutuhan.

Pasal 9 (Pelaporan)

  1. Pengguna yang menemukan konten atau tindakan tidak pantas (termasuk keselamatan anak) dapat melapor lewat fitur lapor di aplikasi atau kontak.
  1. Kami menyelidiki dengan cepat dan mengambil tindakan; laporan keselamatan anak ditangani prioritas utama.
  1. Masalah keselamatan anak juga dapat dilaporkan langsung ke: Kontak Keselamatan Anak — VAULT LLC, Penanggung Jawab Keselamatan Anak, safety@vault-tec.jp.

Pasal 10 (Tindakan terlarang)

Pengguna dilarang: 1. menyamar sebagai orang lain; 2. melanggar KI, hak potret, privasi, atau hak lain; 3. melakukan atau mendorong tindakan ilegal; 4. melecehkan, mengancam, atau mencemarkan; 5. unggahan tidak pantas (kekerasan, cabul, diskriminatif); 6. melakukan atau membantu CSAE; 7. mengunggah/membagikan/menyimpan/menyebarkan CSAM; 8. grooming, sekstorsi, atau eksploitasi seksual anak lainnya; 9. memakai Layanan dengan memalsukan usia; 10. mengganggu operasi atau mengakses server/sistem secara ilegal; 11. tindakan lain yang kami nilai tidak pantas.

Pasal 11 (Tindakan atas pelanggaran)

  1. Atas pelanggaran, kami dapat—dengan atau tanpa pemberitahuan—menghapus Konten, menangguhkan/menghapus akun, dan melapor ke otoritas sesuai hukum.
  1. Untuk pelanggaran keselamatan anak, begitu diketahui kami segera menghapus permanen akun dan melapor ke otoritas.

Pasal 12 (Kekayaan intelektual)

  1. Hak KI atas Layanan serta stiker, templat, efek, materi merek, dan materi lain yang disediakan adalah milik kami atau pemegang hak yang sah.
  1. Pengguna dapat memakai foto yang dibuat dalam Layanan, secara pribadi atau komersial (termasuk unggah ke media sosial), dalam batas Ketentuan ini dan hukum yang berlaku.
  1. Gambar yang diekspor pada tingkat gratis dapat memuat watermark merek kami dan kode QR untuk bergabung ke album.

Pasal 13 (Penafian)

  1. Kami tidak menjamin Layanan bebas dari cacat secara fakta maupun hukum (keamanan, keandalan, ketepatan, kesesuaian untuk tujuan tertentu, dll.).
  1. Kami tidak bertanggung jawab atas masalah antar-Pengguna atau antara Pengguna dan pihak ketiga.
  1. Kami tidak bertanggung jawab meski hasil coretan AI atau pembuatan lain tidak sesuai harapan Pengguna.
  1. Kecuali kesengajaan atau kelalaian berat kami, kami tidak bertanggung jawab atas kerugian Pengguna terkait Layanan.

Pasal 14 (Perubahan/penghentian Layanan)

  1. Kami dapat mengubah spesifikasi, menangguhkan, atau menghentikan Layanan tanpa pemberitahuan.
  1. Kami tidak bertanggung jawab atas kerugian Pengguna akibat perubahan atau penghentian tersebut.

Pasal 15 (Hukum yang berlaku dan yurisdiksi)

  1. Ketentuan ini diatur dan ditafsirkan menurut hukum Jepang.
  1. Sengketa terkait Layanan tunduk pada yurisdiksi eksklusif Pengadilan Distrik Tokyo sebagai instansi pertama.
